Employer’s liability insurance covers an organisation against claims for damages and costs resulting from injuries and/or illness suffered by employees during or arising from their employment, as well as the legal costs incurred in dealing with such claims.

Professional indemnity insurance, sometimes referred to as errors & omissions (E&O), is a form of liability insurance which helps protect professional advisors and service-providing companies from bearing the full cost of defending against a negligence claim made by a client, and damages awarded in such a civil lawsuit. The coverage focuses on alleged failure to perform on the part of, financial loss caused by, an error or omission in the service or product sold by the defendant.
In emerging markets, where communication can be difficult, the law obscure and situations fluid, such coverage can be vital to any organisation where advice to clients is proffered.
Workmens’ compensation insurance provides annuitised, wage replacement benefits and can also provide medical benefits to employees injured as a result of employment. Often this is provided in exchange for mandatory relinquishment of the employee’s right to sue their employer for the tort of negligence.
Here local knowledge is vital in understanding local employment legislation. Often, in emerging economies, local legislation makes no provision for workmen’s compensation. Defense Base Act
Unique legislation, enacted into US law in 1941 as an extension to the Longshore and Harbor Workers Act of 1927, it requires contractors working on US Government compounds abroad, or as subcontractors to the US Government abroad, to carry coverage.
Essentially this is workmen’s compensation with war and terrorism coverage for US government contractors. With premium calculated per US$ 100 of payroll, this can be an expensive but compulsory option. ABL can assist in providing coverage to employees.
Directors and Officers
Directors and officers’ liability Insurance is payable to the directors and officers of a company, or to the organisation itself, as indemnification for losses or advanced payment of defence costs if an insured suffers a loss as a result of, a legal action brought for alleged wrongful acts in their capacity as directors and officers.
Such coverage can extend to defence costs arising out of criminal and regulatory investigations and trials. Often civil and criminal actions are brought against directors and officers simultaneously. Intentional illegal acts are not typically covered under D&O policies. Where a client is at fault for an accident that injures a third party, bodily injury liability coverage helps pay for their medical expenses. Likewise, if a client were to cause an accident that damages someone else’s property, property damage liability coverage helps pay for repairs.

There are many different environmental liability policy wordings available and with market capacity exceeding $200 million per single risk, there are no industry standards for the coverages offered. The result is that the cover can vary a great deal.
